By accessing or using the website digitalkiosky.store ("the Site") or any services provided by Digital Kiosky ("the Company," "we," "us," or "our"), you agree to be bound by these Terms of Use. If you do not agree, please do not use our Site or services.
Digital Kiosky provides digital agency services including but not limited to website design and development, chatbot creation, branding, social media content, business documentation, Google Business setup, SEO, professional email setup, and e-commerce store development. All service scopes, timelines, and deliverables are agreed upon in a separate project brief or service agreement before work commences.
All prices are quoted in US Dollars (USD) unless otherwise agreed. A deposit of 50% is required before project work begins, with the remaining balance due upon project completion and prior to final file delivery or website launch. We accept M-Pesa, Airtel Money, Flutterwave, and bank transfer. All payments are non-refundable once work has commenced, except where Digital Kiosky fails to deliver the agreed scope.
Upon receipt of full payment, the Client owns all final deliverables including website files, logo files, and documents produced specifically for their project. Digital Kiosky retains the right to display completed work in its portfolio unless the Client requests otherwise in writing. All tools, frameworks, templates, and proprietary processes used by Digital Kiosky remain the property of Digital Kiosky.
The Client is responsible for providing accurate business information, content, images, and any other materials required for project completion within the agreed timeline. Delays caused by the Client may result in extended delivery timelines. Digital Kiosky is not liable for any losses arising from inaccurate information provided by the Client.
Each package includes a set number of revision rounds as specified at time of purchase. Revisions beyond the agreed number will be quoted and charged separately. Revisions must be requested within 14 days of delivery. After this period, further changes are treated as new work.
Some services involve third-party platforms (e.g. hosting providers, domain registrars, chatbot platforms, Google services). Digital Kiosky is not responsible for the availability, pricing changes, or policy changes of third-party services. Ongoing costs for third-party services (hosting, domain renewal, chatbot subscriptions) are the Client's responsibility after setup.
Digital Kiosky's total liability for any claim arising from our services shall not exceed the total amount paid by the Client for the specific project in question. We are not liable for indirect, incidental, or consequential damages including but not limited to loss of revenue, loss of data, or business interruption.
Both parties agree to keep confidential any proprietary or sensitive information shared during the course of a project. This obligation remains in effect for two years after project completion.
Either party may terminate a project with 7 days written notice. In the event of termination, the Client pays for all work completed up to the termination date. Digital Kiosky reserves the right to terminate services immediately for non-payment or breach of these terms.
These Terms are governed by the laws of the United Republic of Tanzania. Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the jurisdiction of the courts of Dar es Salaam, Tanzania.
We reserve the right to update these Terms at any time. Continued use of our services after changes are posted constitutes acceptance of the new Terms. For questions, contact us at calvins@digitalkiosky.com.

We retain your contact and project information for up to 3 years after your last interaction with us, to maintain accurate business records and support any follow-up service needs. You may request deletion of your data at any time (see Section 7).
We take reasonable technical and organisational measures to protect your personal information from unauthorised access, loss, or misuse. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.
